Judgment has been handed down in an application to stay two LCIA arbitrations pending the resolution of a challenge to certain procedural orders under s. 68 of the Arbitration Act 1996 (“AA 1996”) and an application to remove the arbitrator under s. 24 AA 1996. The judgment is significant in addressing the Court’s powers to grant relief in the form of a stay, and the interplay between the Court’s role in relation to arbitrations under s. 1 AA 1996 and challenges under ss 24 and 68 AA 1996.
