Circuit Commercial Court decision on economic duress

February 12, 2026

Tom Gentleman acted for the successful claimant at trial in GB Europe Management Services Ltd v RMH Asset GmbH [2026] EWHC 160 (Comm).  This was a claim to recover money lent under a facility agreement to support the acquisition of a German steelworks.  The defendant resisted the claim on the basis that the facility was procured by economic duress.  The court rejected the allegations of duress and upheld the claim in full.

Tom Gentleman, leading Chinmayi Sharma (3VB) acted for the claimant, instructed by Squire Patton Boggs LLP.
