The Court of Appeal handed down judgment on the 7th October dismissing an appeal brought by commodity traders against a judgment of the Divisional Court, which in turn had dismissed claims against the London Metal Exchange arising out of the suspension and cancellation of nickel trades on 8 March 2022. The claimants sought judicial review of the LME’s cancellation decision, and damages against the LME under the Human Rights Act. The claims have been dismissed in their entirety. Jonathan Crow CVO, KC successfully led the team for the LME, both at first instance and in the Court of Appeal. Click here to read the judgment.
