The Court of Appeal has handed down judgment in Navigator Equities v. Deripaska [2024] EWCA Civ 268. The issue arose in the context of a long-running commercial dispute over a valuable development site in Moscow. The judgment clarifies the requirements for a civil contempt, and also deals with the circumstances in which an order for indemnity costs may be appropriate.
