In a judgment handed down on Tuesday 29 July 2025 the Court of Appeal held that the High Court had erred in granting summary judgment on a claim for damages for deceit concerning a series of 10 foreign exchange transaction contracts, allowing the appeal in relation to all but one such contract and reducing the quantum of damages awarded accordingly by some Naira 3 billion. Nugee LJ, in giving the lead judgment, provides some useful guidance as to the proper application of the requirement to avoid a mini-trial: see [33].
