The Court of Appeal (Elisabeth Laing and Zacaroli LJJ) has given judgment in Barclays Bank plc v. Dylan [2025] EWCA Civ 20, dismissing an appeal by Scott Dylan against his sentence of 22 months imprisonment, imposed by Mr Justice Rajah in October last year following Mr Dylan’s admission of two counts of contempt (relating to breaches of freezing orders). The judgment of Zacaroli LJ (with whom Elisabeth Laing LJ agreed) underscores the difficulty faced by contemnors seeking to appeal fact-sensitive sentencing decisions, particularly where an appellant is unable to point to any errors of principle.
