Administrative & Public Law

Commercial disputes, company law, banking and financial services regulation are all liable to give rise to public law issues as well. These may arise in a number of different ways – through regulatory action (e.g. by the FCA), or through public interest proceedings (e.g. director disqualification proceedings), or through commercial-related judicial review proceedings (e.g. challenging regulatory decisions).

We maintain a strong presence in these areas, acting for businesses, private individuals, governments and governmental departments, and regulators. Many of the junior barristers in Chambers are on the various Treasury Panels; most of the silks in Chambers were Treasury Panel members in their time, and one was First Treasury Counsel (Chancery). A current silk is Chair of the Charities Commission.

With extensive experience on both sides of the regulatory fence, Chambers are well placed to assist in public law disputes, particularly those with a commercial complexion.

Members of Chambers have experience of a wide range of matters in this area, including:

  • Judicial review
  • Financial services, telecommunications and natural resources regulation
  • Transport, including rail franchises
  • Human rights
  • Freedom of information
  • Competition
  • Public procurement
  • Director disqualification
  • Professional discipline
