The High Court (Mr Justice Butcher) has handed down judgment in a contested application hearing in the ongoing litigation between ArcelorMittal USA LLC v Ravi Ruia a.ors. Following Mr Justice Henshaw’s judgment in March 2020, in which the Judge found that the Claimant’s particulars of claim did not set out a good arguable case, the Claimant sought to amend its particulars of claim. At a hearing on 19 November 2020 the Defendants resisted certain of the Claimant’s proposed amendments (with the Fifth Defendant resisting the amended case against him in its entirety). The Defendants were largely successful and were awarded the majority of their costs. Gregory Denton-Cox and Nienke van den Berg will continue to act on behalf of the Seventh Defendant in the ongoing litigation.
