Supreme Court considers rule against reflective loss

Today the Supreme Court will hear the appeal in Sevilleja v Marex Financial Ltd. The Appeal concerns the question of whether an unsecured judgment creditor is barred by the rule against reflective loss from recovering against an individual who is alleged to have asset-stripped a company under his control in order to frustrate a judgment debt owed by the company.

The case will have important implications for the rule against reflective loss and, more generally, for the ability of victims of fraud to recover their losses.
