Andrew Clutterbuck QC and Edward Crossley gave a talk to the British Virgin Islands Bar Association on Friday, 3 December 2021. They spoke on Beneficial Ownership Disputes covering sham trusts, the presumptions of resulting trust and advancement, beneficial ownership registers, as well as issues of evidence and proof. The talk concluded with a discussion of how Judges in fact decide these factually sensitive cases.
