The Court of Appeal has handed down judgment in Davies v Ford dismissing both the appeal and cross-appeal. The judgment concerns issues of equitable liability, including whether there can be knowing receipt of a mere opportunity, whether the counterfactual is relevant for the assessment of equitable compensation, and differences between the liability of fiduciaries and third parties.
