On 26 February 2025, Master McQuail handed down judgment in Savva v Cuckoo Hill Limited [2025] EWHC 286 (Ch). Mr Savva entered into a contract for the sale of land near Pinner in London with a company, Cuckoo Hill Limited (βCHLβ). Instead of paying Mr Savva, CHL transferred its assets away before entering dissolution. Mr Savva claimed against CHL and its director Mr Stylianides under s.423 of the Insolvency Act 1986 and asserted that Mr Stylianides was also liable for inducing CHL to breach its contract. After a two day trial, Master McQuail upheld these claims, making multiple findings that Mr Stylianides was relying on forged documents in his defence. Daniel Kessler represented Mr Savva as sole counsel.
